    Starting 5/5/25 at 12:00 a.m. EST and through 5/11/25 at 11:59 p.m. EST, spend $25 in Gift Cards or eGift Cards under one transaction and under one order number and receive one (1) $5 Reward Code. In addition, each online purchase of $30 in online Gift Cards or eGift Cards under one transaction and under one order number will entitle the purchaser to two (2) $5 Reward Codes. This purchase can be made up of multiple lower denominated gift cards and as long as the order total is at least $25 the purchaser will qualify for the promotional offer. This offer is only valid on new online orders placed during the relevant promotional time period defined above.     Introduction

    By participating in the McAlister’s Tea Appreciation Giveaway (“Promotion”), participants agree to comply with and be bound by these Terms and Conditions. McAlister’s reserves the right to amend these terms at any time.

    Sponsor

    This Promotion is sponsored by McAlister’s Franchisor SPV LLC (“Sponsor”).

    Promotion Period

    The Promotion begins at 12:00 AM CST on May 12, 2025 for V-I-Tea Super User Round Entrants(defined herein) and 12:00 AM CST on May 26, 2025 for V-I-Tea Tumbler Round Entrants (defined herein), and ends at 11:59 PM CST on May 16, 2025 for V-I-Tea Super User Round Entrants and on May 30, 2025 for V-I-Tea Tumbler Round Entrants, or when 100 complete submissions are received from V-I-Tea Super User Round Entrants and 200 complete submissions are received from V-I-Tea Tumbler Round Entrants, whichever occurs first (“Promotion Period”).

    Eligibility

    • Open to legal residents of the 50 United States and the District of Columbia who receive an email from McAlister’s with the opportunity to complete a submission form.
    • Entrants must be 18 years of age or older at the time of entry.
    • Entrants must be members of the McAlister’s Rewards program and have visited a McAlister’s location and used their loyalty account 100+ times between May 8, 2024 and May 8, 2025 for the V-I-Tea Super User Round Entrants or 20+ times from May 22, 2024 to May 22, 2025 for the V-I-Tea Tumbler Round Entrants as determined by McAlister’s.
    • Employees, officers, and affiliates of McAlister’s, its parent companies, subsidiaries, advertising agencies, and their immediate family members are not eligible to participate.

    Method of Entry

    • Eligible participants will receive an email invitation on or around May 12, 2025 for VI-Tea Super User Round Entrants and May 26, 2025 for V-I-Tea Tumbler Round Entrants.
    • To enter, participants must complete the provided form in its entirety.
    • Only the first 100 valid form submissions from VI-Tea Super User Round Entrants and first 200 valid form submissions from V-I-Tea Tumbler Round Entrants will qualify to receive the swag box.
    • Limit one (1) entry per individual.

    Prize Details

    (1) V-I-Tea Super User Round Winners:

    Each of the 100 V-I-Tea Super User Round winners will receive a custom swag box (the “Swag Box”) valued at approximately $ $227.14, including:

    (2) V-I-Tea Tumbler Round Winners:

    Each of the 200 V-I-Tea Tumbler Round Entrants winners will receive a Swag Box valued at approximately $121.43, including:

    • Orange Tea Tumbler: $31.73
    • McAlister’s Tea Pass: $89.70

    Prize value does not include shipping, fulfillment, or additional costs.

    Winner Selection

    Winners will be selected based on the order of valid form submissions, with the first 100 eligible V-I-Tea Super User Round Entrants and first 200 V-I-Tea Tumbler Round Entrants qualifying for the prize. No additional criteria will be used.

    Winner Notification

    Winners will receive a prize delivered to the address provided on the entry form on or around the week of July 7, 2025. McAlister’s may contact Winners via the email address provided to confirm shipping details.

    Prize Restrictions

    • Limit one (1) prize per individual and McAlister’s Rewards account.
    • Prizes are non-transferable and cannot be substituted for cash.
    • McAlister’s reserves the right to substitute a prize of equal or greater value in the event of unavailability.

    Publicity Release

    By accepting the prize, recipients grant McAlister’s the right to use their name, likeness, any content submitted, and any social media posts related to this promotion for promotional purposes, in any media now known or hereafter developed, without further compensation or notification, except where prohibited by law.

    Tie-Breaker

    In the event of a tie (e.g., simultaneous form submissions), winners will be selected based on ranking in the Sponsor's data pull.

    General Conditions

    • McAlister’s is not responsible for any incorrect or inaccurate information, technical errors, or other issues that may impact the Promotion.
    • The Sponsor reserves the right to cancel, suspend, or modify the Promotion at its sole discretion.
    • Sponsor (A) shall not be responsible or liable for, and is hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or from entrants’ acceptance, receipt, possession and/or use or misuse of the Swag Box, and (B) has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Swag Box, including, without limitation, quality or fitness for a particular purpose. Personal information collected in connection with this Promotion will be used in accordance with Sponsor’s privacy policy located at https://www.mcalistersdeli.com/privacy.
    • By participating in this Promotion, each entrant agrees: (i) that any and all disputes the entrant may have with, or claims entrant may have against, the Sponsor relating to, arising out of or connected in any way with (a) the Promotion, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (ii) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (iii) the arbitration shall be held in Atlanta, Georgia; (iv) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable entrant may have entered into in connection with the Promotion; (v) the arbitrator shall apply Georgia law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (vi) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only entrant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (vii) the arbitrator shall not have the power to award punitive damages against the entrant or Sponsor; (viii) if the entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of entrant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (ix) with the exception of subpart (vi) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (vi) is found to be invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void, and neither entrant nor Sponsor shall be entitled to arbitrate their dispute.
